What happens at least on GM's vehicles, if you over oil the filter, the oil coats the wire in the mass air meter and it insulates it.  This makes the engine think its getting less air and adversely affects the shifting and engine.  If you use the filter, oil it from the outside of the filter (not engine side) and don't over oil it.  If you notice it running bad, you can remove the screen on the MAF and gently using a cotton swab and rubbing alcohol, clean the small wire.  But be careful as it is fragile.  I Know for a fact that GM has service bulletin out stating this fact.  Not sure about Nissan.

But what do u do about a warrentty issue?

replacing the air filter with an air intake never voids the warranty dorks :)
